ruling on TRO by U.S. District Court

Based on the assurance of the United States Attorney Pamela DeRusha who represents the Department of Interior and the Bureau of Indian Affairs, Judge Justin Quackenbush denied the Temporary Restraining Order today in U.S. District Court.

The assurances were made in a recorded hearing before the judge.  They provide that no adverse action would be taken by the United States and the BIA that could interfere with the RV Park pending the outcome of the dispute.

The RV Park is committed to resolve this matter with the BIA and Allottees by negotiating a settlement if at all possible. The court hearing today provides the RV Park with status quo throughout the litigation.  Any changes would require a specific motion brought before Judge Justin Quakenbush.

Motion for Temporary Restraining Order filed in U.S. District Court

The Mill Bay Members Association filed a Motion for a Temporary Restraining Order along with documents supporting the motion on January 26, 2009 .  There is a telephonic hearing for the Motion scheduled on Thursday, January 29th at 2:00 p.m. before Judge Justin L. Quackenbush.
